On December 4th and 5th, the California EPA hosted the PFAS in California: Past, Present, and Future seminar. Multiple California regulatory bodies were represented, including the California State Water Resources Control Board (SWRCB). In 2019, the SWRCB issued a series of three orders requiring characterization of potential PFAS contamination in soil and groundwater surrounding landfills, airports, and chrome plating facilities. During the seminar, the SWRCB announced their intention to issue a similar order targeting refineries and bulk terminals sometime during CY 2020. Previous SWRCB orders included a mandate to provide a work plan for approval, as well as the final characterization report, within specified timeframes. Given the potential scope of this effort, we suggest that environmental managers coordinate with their consultants to discuss the potential scope and cost of this effort. - If you look for PFAS, where will you find it?
Almost anywhere you look…
- Does PFAS really exist in the blood of people?
Yes – over 98% of the worlds population have detectable concentrations of PFAS in our blood.
- What is the most common exposure route for PFAS historically?
Ingestion of either contaminated drinking water and food, as well as incidental ingestions of PFAS from treated surfaces.
- Which sites in the US have the highest levels of PFAS contamination?
Areas near primary PFAS manufacturing facilities, historically in places like Michigan, New York, and West Virginia, have the highest levels of PFAS contamination.
- AFFF: Does it contain PFAS? Why is it used?
Aqueous Film Forming Foam, or AFFF, does contain PFAS and is used to extinguish flammable liquid fires, which is why it is commonly used in and around O&G facilities
- What other industries routinely use AFFF?
Aviation, military, and other chemical manufacturing also use AFFF for fire suppression. Some local fire departments may also have “foam trucks” to dispatch to vehicle fires.
- Does my company have a written policy regarding PFAS?
This is company specific, but note that DOD regulations for AFFF use in aviation still require PFAS-based AFFF.
- Is AFFF the only source of PFAS?
NO – PFAS compounds are used in a long list of commercial products like food wrappers, water-proofing, non-stick cookware, and personal care products.
- How do you know if you’ve handled or released PFAS and/or AFFF?
Check your purchase records for AFFF so you know how much has been purchased and the maximum potential PFAS onsite.
- Have we donated AFFF Materials to any local municipalities or other entities?
Some Refineries community support activities purchased AFFF or equipment to Local Municipalities Local Fire Departments
- Which contractors have handled PFAS at your site?

- Is there an Inventory of prior AFFF uses for firefighting? Did they record how much?
Because PFAS was not regulated, there are no specific records of usage other than purchase history. Most of the information available about historical usage is anecdotal and comes from employee interviews.
- Is the Toxicity of PFAS Well understood?
- Does PFAS still exist in food packaging, dental floss, sunscreen and other consumer products?
Yes – various forms of PFAS are commonly used for a wide range of commercial products.
- What are the highest levels of PFAS in aquifers in the US?
We only have preliminary surveys of drinking water aquifers, so the highest levels are unknown at this time.
- Do the communities consuming water from those aquifers show epidemiological trends?
Yes – various health effects have been proven to be associated with PFOA and PFOS exposure, including various cancers, high blood pressure, and others.
- What are the established drinking water standards for PFAS in various states?
Drinking water standards vary, but tend to be between 10-20 parts per trillion.
- Who is the Devil you know?
A documentary about PFAS.
- What would it mean to my company if PFAS were listed under RCRA, CERCLA, SDWA and other environmental Laws? Can these laws accommodate new materials?
This is a very complicated question with no single answer. Given the latest regulatory developments, contingency planning is recommended to properly manage any potential liability.
- What is S-K Item 101(c)(1)(xii)?
Appropriate disclosure also shall be made as to the material effects that compliance with Federal, State and local provisions which have been enacted or adopted regulating the discharge of materials into the environment, or otherwise relating to the protection of the environment, may have upon the capital expenditures, earnings and competitive position of the registrant and its subsidiaries. The registrant shall disclose any material estimated capital expenditures for environmental control facilities for the remainder of its current fiscal year and its succeeding fiscal year and for such further periods as the registrant may deem materials.
- Does my company have a PFAS Team?
Don’t let one person in Environmental go off on a wild goose chase. Multiple parties should be consulted. You need communication between multiple groups, an attorney, Public Relations, Accounting, Environmental etc. How you construct the team is important.
- What, when, where, why & how would we go about PFAS sampling?
First questions for the PFAS Team to answer.
- What are the most common sources of contamination when sampling for PFAS?
Handling of food wrappers and wearing clothing/shoes treated with waterproofing are two specific sources. Several states have generated special PFAS sampling protocols to minimize cross-contamination.
- What are Dark Waters?
Movie recently released about PFAS.
- What was the tipping point for PFAS? When did we realize that PFAs may be an issue?
Litigation surrounding PFOA discharges into the Ohio River from the DuPont Washington Works Plant in Parkersburg, West Virginia in the late 1990’s and early 2000’s was the first major action that uncovered exposure risks relating to PFAS. Similar actions in New York and Michigan related to 3M soon followed.
- Are there cleanup standards for PFOA or other specific PFAs Compounds in my state?
Some states have issued plans but many have not. Standards, where they exist, are focused specifically on drinking water.
- What actions have been taken by the California state water board in regard to PFAS?
The Water Board has undertaken a survey of public water systems and issued orders mandating characterization of soil and groundwater at landfills, airports, and chrome plating facilities. They have also issued a Notification Level for PFOA and PFOS in drinking water of 5.1 ppt and 6.5 ppt, respectively.
- What is the Environmental Coordination of States regarding PFAS? Are they working together and sharing data?
States are not coordinating directly, but are sharing information via conferences and the release of various publications.
- Are there many hazardous waste landfills that accept PFAS Waste?
No. Some do, but that needs to be confirmed with each facility.
- Do hazardous waste incinerators accept hazardous waste?
Some do – again, that needs to be discussed in the planning stages.
- Is there a treatment mechanism for PFAS (Final Disposal)?
At this time, only high-temperature incineration is capable of truly destroying a PFAS molecule.
